ACHA/NCAL, through its suggested revisions to the proposed DD regulations, is trying to thwart the Congressionally-mandated authority of P&As to fully investigate abuse and neglect and protect individuals with developmental disabilities. NDRN believes the Department‘s proposed regulations provide helpful clarification and advance important aspects of the DD Act of 2000. We support the Department‘s efforts to implement the general intent to apply the DD and PAIMI acts in a more consistent manner. We believe the Department’s proposed regulations provide helpful clarification on important aspects of FERPA to greater protect the privacy rights of parents and eligible students, such as clearer restrictions on the use of Social Security numbers and personal identification numbers, and covering students who attend classes via a wider variety of distance education modalities.
