Disability Rights New York (DRNY) joined the National Center for Law and Economic Justice (NCLEJ) in filing a class-action lawsuit to address New York’s ventilator allocation guidelines. In April 2020, DRNY filed a complaint with the U.S. Department of Health and Human Services’ Office for Civil Rights about New York State’s guidelines, but the State declined to engage in the early resolution process. The lawsuit is challenging one portion of these guidelines – the reallocation of personal ventilators.
