On March 8, 2020, NDRN joined the Texas & Louisiana P&As, AARP and the Center for Public Representation in an amicus in support of a petition for rehearing en banc in Cummings v. Premier Rehab Keller in the Fifth Circuit. A panel of the Fifth Circuit had held that emotional distress damages were not available in Rehabilitation Act cases.
The Fifth Circuit denied the petition for rehearing in Cummings v. Premier Rehab Keller, in an order dated March 24, 2020.
